Weapons Possession
New York State has some of the toughest laws when it comes to dealing with criminal weapons possession. The penalties, if convicted, are extremely severe. Although, there are different levels of weapons possession, the crime is generally considered a violent offense in New York State with mandatory minimum terms of incarceration. While possession of a switchblade knife or gravity knife is considered a misdemeanor punishable by up to one year in jail, if you possess a loaded firearm outside of your home without a permit you will be charged with felony weapons possession. This offense carries a minimum term of imprisonment of three and a half years in jail, regardless if you have no criminal record.
